Under the Employee Free Choice Act ("EFCA"), a labor union may demand that the National Labor Relations Board certify it as your employees’ collective bargaining representative based on a simple majority (50% + 1) card check process alone--without the need for a traditional secret ballot election. The EFCA was passed by the House of Representatives in 2007, but it stalled in the Senate. President Obama has promised to sign the EFCA if it is passed by Cognress. While it is unclear whether the EFCA will pass as currently proposed, it will certainly make union organizing easier, negotiating a first contract more difficult and increase employer liability.
